The Title 2 ADA regulations out of the United States will take effect in April 2026. The major change here is that the vendors that sell to government entities, such as libraries, will now be required to have accessible web content. This would mean that either the vendor would require accessible eBooks, or create an accessible versions themselves if one does not exist. To date, we have not received notice from any vendors about a plan to remove non-accessible content under this regulation.
However, unlike EAA, Title 2 ADA does technically apply to backlist as well as front list. The best course of action would be as follows:
1. Ensure that all top-selling titles are made fully accessible wherever possible.
2. Ensure all accessible titles are being sent out with up-to-date and robust accessible metadata.
3. Create list of additional backlist titles that are not accessible and require updating.
4. Inquire with your conversion partner or eBOUND about updating them (note that working from the original print PDFs is more cost effective than working from an existing EPUB).
Keep an eye on this space for additional updates as we receive them!
